Terms of service

Last updated: 2026-11-06

1. Agreement

By accessing or using Apogee Watcher (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

2. Business customers

The Service is offered to business customers: companies, agencies, organisations, and self-employed persons (including solo operators) who purchase and use the Service in the course of their trade, business, craft, or profession. It is not intended for consumers buying for private, non-professional use.

By creating an account or placing a paid order, you confirm that you act as a business customer in that sense. EU consumer-distance-selling rules (including the statutory 14-day cooling-off right under the Consumer Rights Directive) therefore do not apply to ordinary purchases under these Terms, except where mandatory law still classifies you as a consumer despite that confirmation. In that case, those mandatory rights prevail over any conflicting clause here or in the Refund policy.

3. The service

Apogee Watcher is an online service for website performance monitoring and related features (including, where available, reporting, alerts, and team collaboration). Features and limits depend on your plan and what we make available in the product at any time. We aim to provide the Service with reasonable care and skill. Where mandatory consumer law on digital services applies to you, nothing in these Terms limits your statutory rights on conformity or remedies.

4. Provider identity

The Service is provided by Apogee Information Systems (together with Apogee Information Systems Luxembourg where relevant for contracting under Luxembourg law).

Commercial register and VAT numbers are available on request via the channels above. Paid subscriptions are sold and invoiced by Dodo Payments Inc. as merchant of record (see section 7); Apogee Information Systems remains the provider of the Apogee Watcher Service.

5. Accounts

You are responsible for the accuracy of information you provide, for safeguarding your credentials, and for activity under your account. You must not misuse the Service (including attempting to probe, scan, or test vulnerabilities without our prior written consent, or interfering with other customers’ use).

6. Acceptable use

You will not use the Service in violation of applicable law, to infringe third-party rights, or to transmit unlawful or harmful content. We may suspend or terminate access if we reasonably believe there is a risk to the Service, to other users, or to third parties.

7. Subscriptions and fees

Fees, billing cycles (for example monthly or annual), taxes, and the total amount payable are as presented at checkout or in your order, unless otherwise agreed in writing. Paid plans renew automatically at the end of each billing period until you cancel. Failure to pay may result in suspension or termination of access.

You may cancel a paid subscription at any time from My Account in the product (or via the Contact / support channels if you cannot access the account). Cancellation stops future renewals. You generally keep access to paid plan features until the end of the current paid period, after which the account may move to a free or read-only state as described in the product. Refunds are described in our Refund policy.

Paid subscriptions are sold and invoiced by Dodo Payments Inc. (the merchant of record — the company that appears on the sale and invoice). Charges on your bank or card statement typically appear as DODOPAY_APOGEEINFORMAT. Dodo Payments Inc.’s checkout and payment terms apply to the payment; Apogee Information Systems remains the provider of the Apogee Watcher Service. For payment or refund queries you may contact us and we will help coordinate with Dodo Payments Inc.

8. Intellectual property

We retain all rights in the Service, software, branding, and documentation. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms and your plan. You retain rights in your content; you grant us the rights needed to operate the Service for you (e.g. hosting, processing, and displaying your data as you configure). Processing of Customer Content on your behalf is further described in our Data Processing Agreement.

9. Third-party services

The Service may connect to third-party tools or services (for example Google PageSpeed Insights for tests). Those services are governed by their own terms and policies.

10. Disclaimers

Except where mandatory law requires otherwise, the Service is provided “as is” and “as available”. We do not guarantee uninterrupted or error-free operation or that results (including scores or recommendations) will meet your business requirements. Nothing in these Terms excludes liability that cannot lawfully be excluded.

11. Limitation of liability

To the maximum extent permitted by applicable law, Apogee Information Systems and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Our aggregate liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, unless mandatory law requires otherwise. These limits do not apply where liability cannot be limited (for example fraud, or death or personal injury caused by negligence, where such rules apply).

12. Termination

You may stop using the Service at any time and cancel paid subscriptions as described in section 7. We may suspend or terminate access for breach of these Terms, risk to the Service, or as required by law. Provisions that by nature should survive (including limitations of liability, intellectual property, and governing law) will survive termination.

13. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above will change. For material changes that affect existing paid subscriptions, we will give reasonable notice (for example by email or an in-product notice) where practicable. Continued use after the effective date of updated Terms means you accept them where the law allows; if you do not agree, you should stop using the Service and cancel any paid subscription before the changes take effect.

14. Governing law

These Terms are governed by the laws of Luxembourg, unless mandatory protections in your country of residence require otherwise (including any mandatory consumer protections that apply despite section 2).

Refund policy

Last updated: 2026-11-04

This Refund policy applies to paid Apogee Watcher subscriptions purchased through our website or checkout. It forms part of our Terms of service.

1. How subscriptions are billed

Paid plans are billed in advance for each billing period (for example monthly or annual), as shown at checkout. Taxes may apply depending on your location and the information you provide. Plans renew automatically until cancelled.

Billing and invoices for paid subscriptions are handled by Dodo Payments Inc. (merchant of record). Payments typically appear on your bank or card statement as DODOPAY_APOGEEINFORMAT. Refunds and payment disputes for those charges are processed through Dodo Payments Inc.; you can also contact us and we will help coordinate with them.

2. Business customers

As stated in the Terms, Apogee Watcher is sold to business customers (including self-employed / solo operators acting in a professional capacity). The standard position below is the commercial refund policy for those purchases.

3. Cancellation

You may cancel a paid subscription at any time from My Account in the product, or via the Contact page / support portal if you cannot access the account. Cancellation stops future renewals. You generally keep access to paid plan features until the end of the current paid period, after which the account may move to a free or read-only state as described in the product and Terms.

Cancelling does not by itself create a right to a refund for the unused portion of the current period for business customers, unless this policy or mandatory law says otherwise.

4. Standard refund position (business customers)

Except as set out below, subscription fees paid by business customers are non-refundable, including for partial periods, unused allowance (tests, sites, or seats), downgrades during a billing period, or change of mind after purchase.

5. Mandatory consumer rights

If mandatory law treats you as a consumer (despite our business-customer offering), nothing in this Refund policy or the Terms reduces rights you cannot waive. That may include a statutory cooling-off / withdrawal right for distance contracts for digital services, and related refund rules. Where such a right applies:

  • you may withdraw within the period and by the method required by that law (you may also contact us or use the support portal and state that you wish to withdraw);
  • we will process any legally required refund through Dodo Payments Inc. to the original payment method when the networks allow it;
  • if the law allows a proportionate charge for use during a cooling-off period after you asked for the Service to start, that charge may be deducted as permitted.

If you believe consumer rules apply to your purchase, say so when you contact us so we can handle the request under the correct regime.

6. Cases where we may refund

We will refund, or adjust, a charge when:

  • we billed you in error (for example a duplicate charge or an incorrect amount we confirm);
  • we are unable to provide the paid Service for a serious, ongoing period for reasons that are our fault, and we cannot reasonably restore access; or
  • mandatory law requires a refund or a cooling-off / cancel-and-refund right that applies to your purchase (see section 5).

We may also issue a courtesy refund or credit at our discretion. That does not create a right for other customers or for future purchases.

7. Free plan and trials

If you use a free plan or a free trial with no charge, there is nothing to refund. If a trial converts to a paid subscription under the terms shown at upgrade/checkout, this Refund policy applies from the first successful paid charge.

8. How to request a refund

Contact us via the Contact page or billing support channels linked at checkout. Include the account email, approximate charge date, amount, how the charge appears on your statement if shown (for example DODOPAY_APOGEEINFORMAT), and the reason for the request. We aim to respond within a few business days.

Approved refunds are returned to the original payment method when Dodo Payments Inc. and your bank or card network allow it. Timing often takes several business days after the refund is submitted.

9. Payment disputes

Please contact us before opening a dispute with your bank or card issuer so we can help resolve billing issues. Unresolved disputes may lead to suspension of the account until the matter is cleared.

Privacy policy

Last updated: 2026-11-06

1. Data controller

Apogee Information Systems (“we”, “us”) is the controller for personal data processed in connection with this website and the Apogee Watcher service, unless we state otherwise (for example where we act strictly as a processor on behalf of a customer). Where we process Customer Content on your behalf as a processor, our Data Processing Agreement applies.

2. What we process

Depending on how you use the Service, we may process: account and contact details (e.g. name, email); login and security-related data; usage and technical logs (e.g. IP address, browser type, timestamps); content you submit (e.g. monitored URLs, site names, team settings); communications you send us; and billing-related data where applicable.

3. Purposes and legal bases

We process data to provide and improve the Service, secure our systems, communicate with you, comply with law, and (where permitted) analyse usage of our website. Under the UK/EU GDPR, our legal grounds may include performing a contract with you, our legitimate interests (for example security and product improvement), and consent where required (for example certain non-essential cookies or marketing).

4. Hosting and location

Production hosting for Apogee Watcher is located in data centres in the European Union. We may use other companies to help run the Service (subprocessors — for example for infrastructure, email, or support) in the EU or elsewhere; where required, we use approved safeguards such as the EU Standard Contractual Clauses (standard EU contract terms for international data transfers). See also the Data Processing Agreement for processor obligations and transfers.

5. Cookies and similar technologies

We use cookies and similar technologies as needed for the Service to function, for security, and to understand how our website is used. You can control cookies through your browser settings.

6. Analytics and third-party scripts

On this site and in the product we may load or use:

  • Matomo — self-hosted web analytics (e.g. analytics.apogee.gr) to measure visits and usage.
  • Google reCAPTCHA — on forms such as sign-up, early access, or newsletter sign-up, to reduce spam (Google may process data as described in their policies).
  • Google PageSpeed Insights — when you run tests, Google processes the requested URLs and related technical data under Google’s terms.

7. Payments

Paid subscriptions are sold and invoiced by Dodo Payments Inc. (merchant of record). We do not include any Dodo-provided code on ordinary marketing or product pages. When you start checkout or update a payment method on our site, we load Dodo’s checkout tools (including a script and payment form) so you can pay securely.

For that purpose, Dodo Payments Inc. processes billing and payment details as needed to complete checkout, invoicing, and refunds, under its own terms and privacy policy. How charges appear on your statement, and how refunds work, are described in our Terms of service and Refund policy.

8. Retention

We retain personal data only as long as needed for the purposes above, including legal, accounting, or security requirements, and for backup and disaster recovery within defined limits.

9. Your rights

Where applicable, you may have rights to access your personal data, correct it, delete it, limit or object to certain processing, and receive a copy (data portability). You may also complain to your local data protection authority. To exercise rights, contact us.
